Sam Pybus strangled a vulnerable woman during sex after drinking 24 bottles of beer and was sentenced to four years and eight months in prison.

A Darlington native pleaded guilty to manslaughter after admitting he killed Sophie Moss by putting pressure on her neck during consensual ‘brutal’ sex but had no intention of harming her.

What Was The Incident?

Sophie Moss, a 33-year-old mother of two, was described in court as a “vulnerable person with poor physical and mental health”.

When she died in February of that year, her children were living with her father and she was living alone. She was in a relationship with another man but had consensual sex with Pybus for three years.

Pybus, who was married, surrendered to Darlington Police Station in the early hours of February 7th of this year.

Prosecutor Richard Wright, QC, said Pybus told detectives that he “must have strangled [Moss] but cannot remember.”

He said he woke up to find her naked and unconscious, but instead of providing first aid, he got into his car and thought about what to do for 15 minutes before going to the police.

An autopsy revealed that he had died of strangulation.

The pathologist said his injuries “do not indicate very long or very violent strangulation, or strangulation that has been actively resisted”.

Wright told the Teesside Crown Court that Pybus claimed that the sexual relationships between him and Moss were “always brutal and he would dominate her during their sexual activities, but he would never go so far as to harm her”.

She said she sometimes put “light pressure” on her neck during sex – “an act that she encouraged and enjoyed”.

Pybus said he made arrangements to go to Moss’ house for sex on 6th February this year after his wife went to bed.

He told police he drank for 10 hours and consumed about 24 bottles of Amstel beer before getting in his car to visit Moss.

He claimed to have little memory of the circumstances of the sex that led to his death.

He said he thought he must have strangled her because her hands were sore, but she couldn’t remember what happened.

Wright told the court that the prosecution “did not accept any form of ‘defense’ from the defendant”. Rather, it was a case in which a murder charge could not be proven beyond doubt.

Inquiry

Justice Minister Alex Chalk said earlier this year: “The perpetrators of these crimes must not be under any illusions; their actions will in no way be justified and they will be vigorously pursued by the courts to seek justice for the victims and their families.”

But we can’t agree, he said, the case showed that the law isn’t working. “It sends a terrible message to women: four years and eight months is an outrageous punishment for killing a woman,” said a spokeswoman.

“We don’t think the law should work that way, and now let’s look at the government to see what it intends to do.”

Moss’ brother James told Teesside Crown Court that his sister was “happy, lively, funny, talented and brave unless she sees a spider”.

The family “will never get rid of the belief” that they “were a victim, exploited and exploited, and that they faced an entirely preventable and infinitely tragic end”.
