Kenneth Cha is a San Francisco police officer who was charged Tuesday with involuntary manslaughter in a 2017 shooting of Sean Moore, an unarmed black man who was shot to death in a confrontation with police outside his home and died in 2020 for the aftermath of his injuries.

Police Officer Cha shot Moore on the steps of his home on the 500 block of Capitol Ave in the city’s Oceanview neighborhood on 6th January 2017 after officers responded at 4 a.m. to a noise complaint from a neighbor who was banned from noise.

Police said Moore, whom his family described as mentally ill, had been combative with police. Police said he kicked an officer in the face during the confrontation, retreated to the house, then returned and struck another officer who was using a baton before advancing on Cha, who opened fire and struck Moore twice.

However, body camera video from officers showed that Moore was trying to avoid the baton blows and was retreating to his home when he was shot.

Kenneth Cha Charged

San Francisco District Attorney Boudin said Tuesday that after reviewing the case, his office presented an affidavit and supporting evidence to a judge who examined him and issued an arrest warrant for Cha.

He is charged with intentional manslaughter, assault with a semiautomatic firearm, personal use enhancement of a firearm, and assault.

The case marks the second murder count against a serving law enforcement officer in San Francisco history.

“We trust that the officers will continue their training and calm situations; Instead, Agent Cha turned a non-violent encounter into one that cost Sean Moore his life in just eight minutes. Sean Moore was unarmed and at home when Agent Cha shot him twice,” Boudin said in a prepared statement.

“After a thorough investigation, my office blames Agent Cha for the death of Sean Moore, who he had no legal basis to arrest. When police officers use wanton violence in blatant disregard for their training, the hard work of other police officers is vilified and our community’s trust in law enforcement is destroyed. To restore that trust, we must hold officials who engage in illegal violence accountable.”

Cha participated in a second shoot in San Francisco four months after Moore was filming.

In May 2020, Cha shot and killed a man with a knife in a restaurant on Market St. Subway who had attacked and stabbed an employee.

San Francisco Police Officers Association President Tony Montoya responded to the allegations made against Cha in the Moore shootings with the following statement: We support Constable Cha’s constitutional right to present his defense against these allegations resulting from this Extremely volatile incident which, according to an autopsy, claimed Mr. Moore’s life while serving his prison sentence in another case.
